Limitation of Liability. The Client acknowledges and agrees that the Nanny shall be an employee of the Client, and that the Nanny shall have no employment, agency, partnership or joint venture relationship with ABN whatsoever. The Client further acknowledges and agrees that ABN does not guaranty the performance of the Nanny hired by Client, the accuracy of information provided to ABN or Client by the Nanny (or the Nanny’s references), and that the performance, duties and responsibility of the Nanny (and any resulting negligence, criminal or wrongful acts) are the sole responsibility of the Nanny and the Client. Furthermore, the Client acknowledges and agrees that the responsibility and decision to hire a Nanny submitted by ABN rests solely with the Client based upon their own interview and review of the applicant Nanny’s qualifications. Upon hiring a Nanny by the Client, the Client agrees that the background work was completed and/or satisfactory. Except for instances of ABN’s willful misconduct and/or fraud, the Client shall release, discharge, hold harmless and defend ABN from any and all claims for damages or losses (including attorney fees) which relate in any way to the employment of a Nanny referred by ABN under this Agreement.
